G.13    RESOLUTION - APPOINTMENT OF CIVIL SERVICE IMPARTIAL

HEARING OFFICERS

      

                        “Motion that based upon the recommendation of the Superintendent of

                        Schools, the Board of Education of the Hamburg Central School District

                        approves of the following resolution:

 

WHEREAS, the Board of Education of the Hamburg Central School District

                        from time to time receives requests to hold hearings pursuant to either Section 71
                        or 73 of the Civil Service Law; and

 

WHEREAS, the Board of Education has determined that when requested,

                        hearings held pursuant to either Civil Service Law Section 71 or 73 shall be
                        conducted by an impartial hearing officer;

 

NOW THEREFORE BE IT RESOLVED THAT the Board of Education does

                        hereby appoint Daniel J. D’Amico, Esq. and Moira H. Cooper, Esq. of Erie 1
                        BOCES Labor Relations Services as its designated impartial hearing officers
                        under Civil Service Law Section 71 and 73 for the purpose of conducting such
                        hearings as may be necessary under those statutes for the duration of the 2016-2017
                        fiscal year; and

 

                        BE IT FURTHER RESOLVED THAT, Daniel J. D’Amico, Esq. and/or
                        Moira H. Cooper, Esq., as applicable, is to make a record of each such hearing
                        which, together with his/her written findings of fact and recommendations on
                        each matter, shall be referred to the Board of Education for review and decision,
                        and be it further resolved that Erie 1 BOCES Labor Relations Service be paid its
                        usual and customary fee for services rendered in these matters.”
  

G.14    CLERK OF THE WORKS SERVICES AGREEMENT 

 

G.15    ERIE 1 BOCES BOARD NOMINATIONS

                        “Motion that the Board nominates Mr. John Sherman, residing at 30 Milton

                        Street, Tonawanda, which is located in the Tonawanda City School District;

and Ms. Janet MacGregor Plarr, residing at 3494 Heatherwood Drive,

                        Hamburg, which is located in the Frontier Central School District; as

                        candidates for election to be held on April 18, 2017, to serve as trustees for

                        the Board of Cooperative Educational Services, First Supervisory District of

                        Erie County, in a term beginning July 1, 2017 through June 30, 2020.”             

 

            G.16    913 EXAM

                        “Motion that, upon the recommendation of the Superintendent of Schools,

                        the Board of Education approves the following resolution: 

 

RESOLVED, that the Board of Education hereby appoints Dr. R.P. Singh as

School Medical Inspector pursuant to Section 913 of the New York State

Education Law in order to evaluate the capacity of the employee named in the

attached confidential Schedule “A.1” to perform his/her duties; and 

 

BE IT FURTHER RESOLVED that pursuant to Section 913 of the New York

State Education Law, the Board of Education directs the employee named in the

attached confidential Schedule “A.1” to appear for a psychiatric examination in

the office of Dr. R.P. Singh at a date and time to be determined.  Such

examination shall be conducted in accordance with the provisions of Section 913

and the report thereof shall be transmitted to this Board of Education and may be

referred to and considered for the evaluation of the service of the employee.  The

employee is hereby directed to cooperate with the Superintendent of Schools in

                        making the necessary appointment with Dr. Singh."
 

            G.17    PAID ADMINISTRATIVE LEAVE

“Motion that, upon the recommendation of the Superintendent of Schools,

the Board of Education approves the following resolution:

 

                        RESOLVED, that the Board of Education of the Hamburg Central School

                        District places an employee named in the attached confidential Schedule “A.1”

                        on paid administrative leave commencing on March 13, 2017."

 

            G.18    2017-2018 DISTRICT CALENDAR

                        “Motion that based upon the recommendation of the Superintendent of

                        Schools, the Board of Education of the Hamburg Central School District

                        approves the 2017-2018 District Calendar.”

 

            G.19    APPOINTMENT OF LEGAL COUNSEL  

                        “Motion that the law firm of Webster Szanyi LLP be appointed as legal

                        counsel for the school district effective March 15, 2017.”
  
 
H.        PUBLIC EXPRESSION AND INFORMATION  

PERSONS WISHING TO ADDRESS THE BOARD

Some topics are not permitted to be discussed in the public forum; for example, any topic related
to an employee or that can be implied to be related to an employee; special education placements,
individual student situations, etc. If the topic is inappropriate for the public forum, the Board
president will instruct you not to speak, but rather, present your concerns in writing for the
Board’s discussion in Executive Session.

According to the district’s Civility Policy #3150, the district promotes mutual respect, civility,
and orderly conduct among District employees, parents, and the public. The policy is not
intended to deprive any person of his or her right to freedom of expression. Rather, seek to
maintain, to the extent possible and reasonable, a safe, harassment-free workplace for students
and staff. In the interest of presenting teachers and other employees as positive role models,
we encourage positive communication and discourage volatile, hostile, or aggressive actions.

            This District seeks public cooperation with this endeavor.
 

According to the district’s Code of Conduct on School Property Policy #3410, there are
provisions regarding conduct deemed appropriate and acceptable on school property and at
school functions, conduct deemed unacceptable and inappropriate on school property; and
provisions regarding acceptable civil and respectful treatment of teachers, school administrators,
other school personnel, students and visitors on school property and at school functions
(school board meetings).

The chair will recognize the individual or group. Individuals must identify themselves with name
and address. The board will allocate a maximum of thirty (30) minutes for this agenda item.

            Speakers shall have a maximum of five (5) minutes each.In the event more than six (6) persons
            wish to address the board, they will each receive a proportionate share of the time.
